On the 5th of February, 2019, President Muhammadu Buhari signed into law the Federal Competition and Consumer Protection Act, 2019 (FCCPA), which repeals the provisions of the Investments and Securities Act, 2007 regulating mergers and strips the Securities and Exchange Commission (SEC) of its primary regulating powers on Mergers.
Consequently, the primary regulatory authority that sanctions mergers in Nigeria is now the Federal Competition and Consumer Protection Commission (“Commission “) and no longer the SEC.
